ROE V. WADE OVERTURNED BY THE DOBBS DECISION JUNE 2022

  • Dobbs v. Jackson Women's Health Organization (Oyez) [Legal Information Institute, Cornell Law School, Justia, IIT Chicago-Kent College of Law (Illinois Institute of Technology)]
  • Opinion of the Court (written by Justice Alito)

    QUOTES FROM ABOVE OPINION:
"For the first 185 years after the adoption of the Constitution, each State was permitted to address this issue in accordance with the views of its citizens. Then, in 1973, this Court decided Roe v. Wade, 410 U.S. 113.....Although the Court acknowledged that States had a legitimate interest in protecting "potential life,"[1] it found that this interest could not justify any restriction on pre-viability abortions....At the time of Roe, 30 States still prohibited abortion at all stages. "

"We hold that Roe and Casey must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision, including the one on which the defenders of Roe and Casey now chiefly rely—the Due Process Clause of the Fourteenth Amendment....Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences....It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives."

    QUOTES FROM JUSTICE KAGAN'S DISSENT:

"The majority would allow States to ban abortion from conception onward because it does not think forced childbirth at all implicates a woman's rights to equality and freedom."

"The Court then understood, as the majority today does not, that the men who ratified the Fourteenth Amendment and wrote the state laws of the time did not view women as full and equal citizens....Without the ability to decide whether and when to have children, women could not—in the way men took for granted—determine how they would live their lives, and how they would contribute to the society around them."
